Terms of Service for Daily Disaffirmation

1. Agreement to Terms

By accessing or using the Daily Disaffirmation mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

Operator: Daily Disaffirmation ("we," "us," or "our")

Age Requirement: You must be at least 13 years old to use this App. By using the App, you represent that you are at least 13 years of age.

2. Description of Service

Daily Disaffirmation is a mobile application that provides:

Daily darkly humorous "disaffirmation" quotes
Beautiful gradient backgrounds
Sharing functionality for quotes
User account management
Subscription-based access to premium content

3. Account Registration

Creating an Account

To use the full features of the App, you must:

Provide a valid email address
Create a secure password
Provide accurate information
Maintain the security of your account credentials

Account Responsibilities

You are responsible for:

All activities that occur under your account
Maintaining the confidentiality of your password
Notifying us immediately of unauthorized access
Any consequences of unauthorized use of your account

We are not liable for any loss or damage from your failure to maintain account security.

Account Termination

You may delete your account at any time through the App settings. We may suspend or terminate your account if you:

Violate these Terms
Engage in fraudulent activity
Abuse the service or other users
Fail to pay subscription fees

4. Subscription Terms

Subscription Plans

Daily Disaffirmation offers the following subscription:

Annual Subscription: Price may vary by region
Auto-renews annually unless cancelled

Payment Terms

Payment Method: Subscriptions are processed through Apple's In-App Purchase system
Automatic Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
Price Changes: We may change subscription prices with 30 days' notice
Taxes: Prices are exclusive of applicable taxes

Free Trial (if applicable)

Free trials (if offered) last for the specified period
You will be charged when the trial ends unless you cancel before it expires
Only one free trial per user

Cancellation

You can cancel your subscription at any time:

Tap your name
Tap Subscriptions
Select Daily Disaffirmation
Tap Cancel Subscription

Cancellation takes effect at the end of the current billing period. You will retain access until then.

Refund Policy

Apple Store Subscriptions:

Refunds are handled by Apple according to their refund policy
We cannot issue refunds directly for App Store purchases
Contact Apple Support for refund requests
Refunds are at Apple's sole discretion

Our Refund Policy:

We do not offer refunds for partial subscription periods
No refunds for unused portions of the subscription
Exceptional circumstances may be considered on a case-by-case basis (contact us)

5. Content and Intellectual Property

Our Content

All content provided in the App, including:

Disaffirmation quotes
Background images
App design and layout
Text, graphics, logos
Software code

is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws.

License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to:

Access and use the App for personal, non-commercial purposes
View and share quotes as permitted by the sharing feature
Download cached images on your device

You may NOT:

Modify, reverse engineer, or decompile the App
Copy, reproduce, or distribute our content commercially
Remove copyright or proprietary notices
Use the App for any illegal purpose
Create derivative works based on our content

User-Generated Content

When you share quotes using our sharing feature:

You retain ownership of your shared content
You grant us a non-exclusive license to display and facilitate sharing
We are not responsible for how third parties use your shared content

6. Acceptable Use Policy

You agree NOT to:

Use the App for any illegal purpose
Harass, abuse, or harm other users
Attempt to hack, breach security, or interfere with the App
Use bots, scripts, or automated tools
Upload viruses or malicious code
Impersonate others
Scrape, data mine, or extract content
Reverse engineer the App
Resell or redistribute our content
Use the App in any way that damages our reputation

Violation may result in immediate account termination.

7. Third-Party Services

The App integrates with third-party services:

Apple App Store - For payment processing
RevenueCat - For subscription management
Supabase - For authentication and data storage

Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party service failures or changes.

8. Disclaimers and Limitations of Liability

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Warranties of merchantability
Fitness for a particular purpose
Non-infringement
Uninterrupted or error-free service

The disaffirmations provided are:

For entertainment purposes only
Not professional advice (mental health, legal, financial, etc.)
May contain dark humor or sarcasm
Should not be taken seriously or as guidance

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

Indirect, incidental, special, consequential, or punitive damages
Loss of profits, data, use, or goodwill
Service interruptions or errors
Third-party actions
Unauthorized access to your account

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SUBSCRIPTION IN THE 12 MONTHS BEFORE THE CLAIM.

11. Changes to Terms

Continued use of the App after changes constitutes acceptance of the new Terms. If you do not agree, you must stop using the App and cancel your subscription.

12. Termination

You may terminate your account at any time by:

Deleting your account in App settings
Uninstalling the App

By Us

We may terminate or suspend your access immediately, without notice, if you:

Violate these Terms
Engage in fraudulent or illegal activity
Abuse the service
Fail to pay subscription fees
Create risk or legal exposure for us

Upon termination:

Your access to the App will be revoked
Your data may be deleted (subject to legal retention requirements)
Paid subscriptions are non-refundable (unless required by law)

13. Dispute Resolution

Governing Law

These Terms are governed by the laws of Texas, USA, without regard to conflict of law principles.

Informal Resolution

Before filing a claim, please contact us at contact@dailydisaffirmation.com to resolve the dispute informally. We'll work in good faith to resolve issues.

Class Action Waiver

To the extent permitted by law, all claims must be brought in an individual capacity, not as part of a class action or representative proceeding.

Jurisdiction

Any disputes not subject to arbitration shall be resolved in the courts of Texas, USA.

14. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in effect.

Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

Assignment

You may not assign or transfer these Terms. We may assign our rights without restriction.

Force Majeure

We are not liable for failures or delays due to circumstances beyond our reasonable control (natural disasters, war, pandemics, etc.).

Survival

Provisions that by their nature should survive termination will survive (e.g., intellectual property, disclaimers, limitations of liability).

Export Compliance

You may not use or export the App except as authorized by U.S. law and the laws of the jurisdiction where you obtained the App.

15. Apple-Specific Terms

These Terms are between you and us, not Apple
Apple has no obligation to provide support for the App
Apple is not responsible for the App or its content
Apple is not liable for claims related to the App
You represent that you are not located in a country subject to a U.S. Government embargo
Apple and its subsidiaries are third-party beneficiaries of these Terms
